Passengership and Related Liability Insurance Regulations

Insurance regulations in relation to liability for ship passenger and related claims will come into force in Canada on January 11, 2019. See the Canada Gazette December 12, 2018, issue here, at page 4327.

In short, the regulations require operators to have liability insurance coverage for damages for death or personal injury caused by an incident occurring in the course of the carriage and which is due to the fault or neglect of the person or the person’s servants or agents acting within the scope of their employment.

The insurance coverage is required to be for an amount not less than CAD250,000 multiplied by the passenger capacity of the ship, and proof of insurance must be carried on board the ship.

Transition rules deal with application to existing policies and new ones.
